Terms of Service.

1. Acceptance of Terms

By downloading, installing, or using CueTally ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and JudeTech Solutions Ltd, trading as JD ("we," "our," or "us").

2. CueTally Club

One-Time Purchase

• What it is: CueTally Club is a one-time in-app purchase. It unlocks Club features, such as unlimited games, all your statistics, head-to-heads and every Learn stage, on any device signed in to your account. The App shows which features are free and which are in Club
• Price: The price is shown in the App, in your local currency, before you buy
• No Subscription: There is no free trial, renewal, or recurring charge for the one-time purchase
• Payment: Payment will be charged to your Apple ID or Google Play account at confirmation of purchase. Purchases are processed by Apple or Google, and we never see your card or payment details
• Restoring: Your purchase stays with your Apple ID or Google account. You can restore it with "Restore purchases" in the App
• Member numbers: Every Club member gets a member number, and the first members a Founding Member number. A number belongs to your account; it can't be transferred, and it isn't given out again if you delete your account

Existing Annual Subscribers

• The annual subscription is no longer offered. If you have one, your account becomes a Club member automatically, at no extra cost
• Your old subscription keeps renewing until you cancel it, so cancel it as described in section 3

3. Cancellation & Refunds

How to Cancel an Old Annual Subscription

• iOS: Go to iPhone Settings → [Your Name] → Subscriptions → CueTally → Cancel Subscription
• Android: Open Google Play Store → Menu → Subscriptions → CueTally → Cancel
• Cancelling stops future renewals; you keep CueTally Club either way

Refund Policy

• Purchases are processed by Apple and Google, and their standard refund policies apply. Refund requests should be made to Apple or Google
• No refunds will be provided for unused portions of an annual subscription period
• If a purchase is refunded, CueTally Club may be removed from your account

4. Acceptable Use

You agree to use CueTally responsibly and in accordance with these Terms. You must not:

• Manipulate, cheat, or artificially inflate game statistics or scores
• Share your account credentials with others
• Use the App for any illegal or unauthorized purpose
• Interfere with or disrupt the App's functionality or servers
• Engage in harassment, abuse, or inappropriate behavior in multiplayer features
• Attempt to reverse engineer, decompile, or extract source code from the App
• Use the App in any way that could damage our reputation or business

5. Game Data & Statistics

• CueTally tracks your snooker and billiard game statistics to the best of its ability
• We do not guarantee the absolute accuracy of all tracked statistics
• You are responsible for backing up your own game data
• Data synchronization across devices may have limitations
• We may store your game data on secure cloud servers to provide synchronization features

6. Multiplayer Features & Code of Conduct

When using multiplayer features, you agree to:

• Treat other players with respect and courtesy
• Not engage in cheating, harassment, or unsportsmanlike conduct
• Respect the privacy of other players
• Report inappropriate behavior through the App's reporting features
• Understand that multiplayer interactions are not monitored in real-time

7. Intellectual Property

• CueTally, including its design, features, and content, is owned by JudeTech Solutions Ltd
• All trademarks, logos, and brand names are the property of their respective owners
• You retain ownership of any content you create within the App (such as player profiles)
• By using the App, you grant us a license to use your content as necessary to provide the service
• You may not copy, modify, distribute, or create derivative works of the App

8. Privacy & Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information. By using CueTally, you agree to our data practices as described in the Privacy Policy.

9. Updates & Changes

• We may update CueTally from time to time to add new features, fix bugs, or improve performance
• We reserve the right to modify these Terms at any time
• Material changes will be communicated through the App or via email
• Continued use of the App after changes constitutes acceptance of the new Terms
• We may discontinue or modify features with reasonable notice

10. Limitation of Liability

CueTally is provided "as-is" without warranties of any kind. To the maximum extent permitted by law:

• We do not guarantee uninterrupted or error-free service
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid for CueTally Club in the past 12 months
• We are not responsible for data loss, though we make reasonable efforts to protect your data
• You use the App at your own risk

11. Account Termination

Termination by You

You may stop using CueTally at any time. You can delete your account in the App (You → Delete account) or by emailing admin@judedon.com. If you have an active annual subscription, cancel it as described in section 3; deleting the App or your account does not cancel it.

Termination by Us

• We may terminate your access for violations of these Terms
• Termination may result in loss of access to premium features and stored data
• Club access may be removed without refund in cases of Terms violations
• We will make reasonable efforts to provide notice before termination

12. Third-Party Services

CueTally may integrate with third-party services (such as Apple Game Center, Google Play Games, or social media platforms). Your use of these services is subject to their respective terms and privacy policies.

13. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes will be resolved in the courts of England and Wales. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
